This agreement contains information about what is covered in the inspection and how it is conducted.
ARTICLE 1
SCOPE AND STANDARD
1.1 Parties and Inspection Details
“Inspection Company” means the individual or legal entity identified as the service provider in the written booking confirmation or quotation supplied to the Client.
“Inspector” means the person identified in that confirmation or quotation as performing the Inspection, together with any employee or contractor engaged by the Inspection Company to assist with or perform the Inspection.
“Client” means the individual or legal entity requesting the Inspection and identified in the accompanying client details.
“Subject Property” means the inspection address provided in this form and confirmed in the written booking confirmation or quotation.
1.2 Inspection Scope
The Client requests a CSA B365-referenced visual, non-invasive assessment of the agreed solid-fuel heating appliance or appliances and associated venting system at the Subject Property.
The Inspection is limited to visible conditions of components that are readily accessible at the time of inspection. Observed installation characteristics may be compared with applicable manufacturer’s instructions and referenced to CSA B365. A written Inspection Report will be provided within three business days.
The Inspection Report provides information about the observed installation. It is not a certification, approval, engineering evaluation, warranty, guarantee, or determination of code compliance. It is not an inspection or certification performed by WETT Inc. and does not guarantee acceptance by an insurer or authority having jurisdiction.
1.3 Inspection Limitations
The Inspection is not technically exhaustive and does not include:
A. Dismantling, disassembly, destructive investigation, or removal of finishes or components.
B. Verification of concealed clearances, concealed construction, internal flue or chimney conditions, or system design capacity.
C. Determination of system performance under every operating condition.
D. Identification of concealed, latent, dormant, intermittent, or changing conditions.
E. Movement of furnishings, stored items, appliances, or personal property.
F. Entry into confined, inaccessible, or unsafe spaces.
G. Walking on roof surfaces or entering attic spaces.
H. Operation of equipment that is shut down, disconnected, unsafe, inaccessible, or otherwise unsuitable for operation.
Roof and exterior observations are made from accessible locations considered safe by the Inspector, which may be limited to ground-level vantage points, decks, balconies, or other readily accessible areas.
The Inspection may be limited by weather, snow, ice, property conditions, accessibility, visibility, safety concerns, and conditions existing at the time of inspection. The Inspection Report represents the Inspector’s opinion based solely on the conditions observed at that time.
1.4 Life-Safety Devices
Evaluation or testing of life-safety devices is outside the scope of the Inspection. These devices include smoke alarms, carbon-monoxide alarms, ground-fault circuit interrupters and arc-fault circuit interrupters.
The presence, placement, operation, compliance, and remaining service life of these devices are not determined. Where confirmation is required, the Client should obtain further assessment from an appropriately qualified professional or the authority having jurisdiction.
1.5 Cancellation
Either party may cancel the Inspection at any time and for any reason before delivery of the Inspection Report. No cancellation fee or other amount is owed solely because of the cancellation. Any payment received for services not completed will be refunded.
1.6 Use of Inspection Report
A. The Inspection Report is prepared solely for the Client and for the purpose identified in this Agreement and the written booking confirmation or quotation.
B. No person may rely upon the Inspection Report for a purpose other than its stated purpose without the Inspection Company’s written consent.
C. Providing the Inspection Report to another person does not expand the inspection scope, create a separate inspection obligation, or make that person a client of the Inspection Company.
1.7 Client Responsibilities
The Client is responsible for reviewing the Inspection Report and acting promptly upon its findings. Conditions identified in the report may require further assessment or corrective work by an appropriately qualified professional.
1.8 Intellectual Property
The Inspection Report, photographs, notes, and other materials produced by the Inspector remain the Inspector’s intellectual property. The Client receives a limited right to use the Inspection Report for its intended purpose.
ARTICLE 2
TERMS
2.1 Limitation of Liability
To the fullest extent permitted by law, the total aggregate liability of the Inspection Company, the Inspector, and their employees and contractors for all claims arising from or relating to the Inspection, the Inspection Report, or this Agreement is limited to the inspection fee paid by the Client.
This limitation applies regardless of whether a claim is advanced in contract, negligence, negligent misrepresentation, or otherwise, but does not apply where liability cannot lawfully be limited.
2.2 Time Limitation
To the fullest extent permitted by law, any legal proceeding arising from or relating to the Inspection, the Inspection Report, or this Agreement must be commenced within one year after the date of the Inspection. After that date, the claim is barred.
2.3 Reliance on the Inspection Report
The Client may rely upon the Inspection Report for its stated purpose, subject to the scope, exclusions, limitations, and recommendations contained in this Agreement and the Inspection Report.
Where the Inspection Report recommends further assessment, verification, investigation, or corrective work, the Client is responsible for obtaining that service from an appropriately qualified professional before relying upon the condition for the intended transaction, insurance decision, installation, use, or corrective work.
2.4 Fee
The inspection fee, any additional appliance or travel charges, applicable taxes, and total payable are itemized in the invoice provided before you accept this agreement. Payment is due at the time of inspection.
